Notification on given authorization for personal data processing with data processing notice

Your personal data will be processed by the company VON HELDEN UND GESTALTEN d.o.o. Novi Sad, having its registered address at Dr Milana Petrovića 2a, reg. No. 21303178, Tax ID No. 110129057 (hereinafter referred to as the "Controller").

Controller shall process Your personal data that You have voluntary and self-initiated provided during, and for the purpose of, applying for a job with the Controller, namely the following data: your name and surname, date of birth, residential address and/or residential address, telephone numbers, e-mail address, degree and type of education, length of service, information about employers, your work experience, personal qualities and skills.

The legal ground for the processing of Your personal data is your consent for processing, and which consent will be considered as given by applying for a job advertisement with the Controller, as well as the legitimate interests pursued by the Controller.

For achieving the purpose of processing, based on Your given consent, Your personal data may be provided to employees of the Controller, suppliers of services from the field of accounting, competent authorities when it is obligatory and necessary, as well as to the Controller`s sole Shareholder - the company VON HELDEN UND GESTALTEN GmbH, incorporated in Germany, having its registered address at Rotebühlstraβe 44, 70178 Stuttgart, for the purpose of further HR processing.

Furthermore, your personal data may be transferred to another country where the Controller operates, namely to the Germany and to other member countries of the European Union, where an adequate level of personal data protection is provided in accordance with the Decision on the list of countries, parts of their territories or one or more sectors of certain activities in those countries and international organizations in which it is considered that an appropriate level of personal data protection is provided ("Official Gazette of RS" No. 55/2019).

We hereby notify and inform you that by applying for a job advertisement with the Controller, you unquestionable agree, i.e. you give clear consent for the processing of the above-listed personal data, and at the same time you agree, i.e. give your consent, that the Controller can contact you directly in the future in the event of the opening of vacant positions that match your qualifications.

Your collected personal data will be stored by the Controller for a period of up to 3 (three) years from the date of their collection, in order to achieve the above-mentioned purpose of processing, as well as for the purposes of potential subsequent contacting you as a candidate for future open positions with the Controller. Your data can be stored longer only in cases prescribed by law.

In accordance with the Data Protection Act ("Official Gazette of RS" No. 87/2018) and other regulations of the Republic of Serbia concerning the protection of personal data, and under the provisions defined therein, you have the following rights concerning Your personal data: right to be informed on the personal data processing, right of access, right to data rectification, data supplement, right to erasure (right to be forgotten), right to restriction of processing, right to object, and right to data portability.

In addition to the above stated rights, regarding the data that is processed based on Your consent, You have the right to withdraw the consent for the processing, at any time, provided that the withdrawal of consent shall not affect the lawfulness of processing based on consent before its withdrawal.

If, after contacting us, you consider that your rights are not respected or that the data processing does not comply with data protection rules, you have the right to lodge a complaint to the Commissioner for Information of Public Importance and Personal Data Protection of the Republic of Serbia.

Providing of Your personal data is a necessary condition for the performance of intended purposes of processing. Giving inaccurate or untrue information may result in Your liability for the damage caused thereby, as well as in any other consequences prescribed by applicable regulations.

After we receive your personal data, we apply all reasonable and appropriate measures and controls to prevent as much as possible any accidental or unlawful loss, destruction, alteration or unauthorized access, and to achieve an appropriate level of security in relation to the risk.

Our goal is to always keep your data safe and secure as much as possible, in accordance with the level of technological achievements and the costs of their application, the nature, scope, circumstances and purpose of processing, as well as the probability of the occurrence of risks and the level of risk to the rights and freedoms of individuals.

In case that, after reading this information, for any reason, you do not agree, i.e. you do not consent to the processing of your personal data as stated above, please do not apply for job advertisement with the Controller.

Obaveštenje o pristanku na obradu podataka o ličnosti sa informacijama o obradi

Rukovalac Vašim podacima o ličnosti je privredno društvo VON HELDEN UND GESTALTEN d.o.o. Novi Sad, sa sedištem u ul. Dr Milana Petrovića 2a, matični broj: 21303178, PIB: 110129057 (u daljem tekstu: „Rukovalac“).

Rukovalac će obrađivati Vaše podatke o ličnosti koje ste mu vi dobrovoljno i samoinicijativno dostavili prilikom, i u svrhu, apliciranja za posao kod Rukovaoca, i to naročito sledeće podatke: Vaše ime i prezime, datum rođenja, adresu prebivališta i/ili adresu boravišta, brojeve telefona, e-mail adresu, stepen i vrstu obrazovanja, dužinu radnog staža, informacije o poslodavcima, vašem radnom iskustvu, osobinama i veštinama.

Pravni osnov obrade Vaših podataka o ličnosti je Vaš pristanak na obradu, a koji Vaš pristanak se smatra nesumnjivo datim samim apliciranjem na oglas na posao kod Rukovaoca, kao i ostvarivanje legitimnih interesa Rukovaoca.

U cilju ostvarivanja svrhe obrade, a na osnovu Vaše saglasnosti, Vaši podaci o ličnosti mogu biti dostavljeni drugim zaposlenima kod Rukovaoca, pružaocima usluga iz oblasti računovodstva, nadležnim organima kada je to obavezno i potrebno, kao i jedinom članu Rukovaoca - kompaniji VON HELDEN UND GESTALTEN GmbH, privrednom društvu registrovanom u Nemačkoj, sa sedištem u Rotebühlstraβe 44, 70178 Stuttgart, a u svrhu kadrovske obrade podataka.

Takođe, vaši podaci mogu biti izneti u drugu državu u kojoj posluje Rukovalac, i to pre svega u Nemačku, ali i u druge države članice Evropske Unije, a u kojima je obezbeđen primeren nivo zaštite podatka o ličnosti shodno Odluci o listi država, delova njihovih teritorija ili jednog ili više sektora određenih delatnosti u tim državama i međunarodnih organizacija u kojima se smatra da je obezbeđen primereni nivo zaštite podataka o ličnosti („Sl. glasnik RS“ br. 55/2019).

Napominjemo i ovde Vas obaveštavamo da samim Vašim apliciranjem na oglas za posao kod Rukovaoca dajete svoju nesumnjivu saglasnosti, odnosno dajete svoj jasan pristanak za obradu gorenavedenih podataka o ličnosti, te da istovremeno dajete i saglasnost, tj. pristajete, da Vas Rukovalac u budućnosti može direktno kontaktirati u slučaju otvaranja upražnjenih mesta koja odgovaraju vašim kvalifikacijama.

Vaši prikupljeni podaci o ličnosti će se čuvati od strane Rukovaoca u periodu do 3 (tri) godine od dana njihovog dostavljanja, a u cilju ostvarivanje gorenavedene svrhe obrade, kao i za potrebe eventualnog naknadnog kontaktiranja Vas kao kandidata za buduća otvorena radna mesta kod Rukovaoca. Vaši podaci mogu biti čuvani duže isključivo ukoliko je to propisano zakonom.

U skladu sa Zakonom o zaštiti podataka o ličnosti („Sl. glasnik RS“ br. 87/2018) i drugim važećim propisima Republike Srbije iz oblasti zaštite podataka o ličnosti i pod propisanim uslovima, imate sledeće prava u vezi sa Vašim podacima o ličnosti: pravo da budete informisani o obradi vaših podataka o ličnosti, pravo na pristup, ispravku, dopunu ili brisanje podataka, pravo na ograničenje obrade, pravo na prigovor, pravo na prenosivost podataka.

Pored prethodno navedenog, u pogledu podataka o ličnosti koji se obrađuju na osnovu Vašeg pristanka, imate i pravo da opozovete pristanak za obradu u bilo koje vreme, s tim da opoziv pristanka ne utiče na dopuštenost obrade na osnovu pristanka pre opoziva.

U slučaju da, nakon što nas kontaktirate, smatrate da se Vaša prava ne poštuju ili da se obrada Vaših podataka o ličnosti sprovodi suprotno propisima iz oblasti zaštite podataka o ličnosti, imate pravo na pritužbu Povereniku za informacije od javnog značaja i zaštitu podataka o ličnosti Republike Srbije.

Davanje Vaših podataka o ličnosti predstavlja neophodan uslov za izvršenje nameravane svrhe obrade. Davanje netačnih ili neistinitih podataka za posledicu može imati Vašu odgovornosti za prouzrokovanu štetu, kao i eventualne druge posledice u skladu sa važećim propisima.

Nakon što dobijemo Vaše podatke o ličnosti, primenjujemo sve razumne i odgovarajuće mere i kontrolu kako bismo u najvećoj mogućoj meri sprečili bilo kakve slučajne ili nezakonite gubitke, uništenja, izmene ili neovlašćeni pristup, te dostigli odgovarajući nivo bezbednosti u odnosu na rizik.

Naš cilj je da Vaše podatke uvek čuvamo bezbednim i sigurnim koliko god je to moguće, a u skladu sa nivoom tehnoloških dostignuća i troškovima njihove primene, prirodom, obimom, okolnostima i svrhom obrade, kao i verovatnoćom nastupanja rizika i nivoom rizika za prava i slobode fizičkih lica.

Ukoliko nakon čitanja ove informacije iz bilo kog razloga niste saglasni, odnosno ne pristajete na obradu Vaših podataka o ličnosti kako je to gore navedeno, molimo vas da ne aplicirate na konkurs za posao kod Rukovaoca.
